Justice for Nye Frank
With the recent passing of his one year death anniversary friends and family of Gordon “Nye” Frank are asking for support in getting his death reviewed by the California Attorney General. It turns out that Riverside County deemed his death a “mutual combat or; he said, she said” event making it hard to prosecute so they dropped the case against Ty Reddish with Reddish spending only three days in jail.
Bas ically, Nye (68 years old) died within minutes of leaving the scene after being assaulted by the 27 year old. Nye’s wife, Lee, was the only witness who says that when they drove down to get the newspaper, at their rural delivery spot, Reddish came out yelling about how fast Nye was driving. Lee later told the police, "My husband did not lay a hand on him. He was the one who started everything. He's the one who wouldn't walk away. He's the one who choked my husband.”
Reddish, a former high school wrestling athlete, has a different version. He told police he approached Frank and screamed, "You know, when my kids are here and you are driving that fast down the road, we are going to have problems, and we're going to be fighting." Reddish then told investigators that Nye took off his glasses and put his fists up in a boxing stance and called Reddish a "young punk." Reddish then states that Nye said, "I'm doing everything I can to provoke you." I personally found that statement odd coming from someone suppose to be mad enough to fight until I read the report where his statements were made after his father had sought legal council on how to handle the inc ident and were advised to handle it as mutual combat. Reddish said he did not confront Nye seeking a fight, but that happened because Frank attacked him first. Friends of Nye find it hard to believe coming from one who was 68 years old, with no history of violence, facing a young athletic man more than half his age.
Reddish says Nye threw the first punch. Lee says Nye never threw a punch but simply pulled her out of the way before Reddish threw Nye to the ground and choked him unconscious.
Nye’s daughter Dawana Breedlove-Samimi says there are basically two ways to seek justice. One is for the Attorney General to reopen the case and make an independent decision; the other is to sue for wrongful death. It will take a strong show of support (especially from those in Riverside County) to get the Attorney General to act and going to court is real expensive.
